Lolë contest Official rules and regulations


NO PURCHASE NECESSARY. VOID WHERE PROHIBITED BY LAW.
PURCHASING WILL NOT IMPROVE YOUR CHANCES OF WINNING.


1. The “Win a bike!” Contest is held by Coalision Inc. (the “Contest Organizers”). The Contest will run during business hours in approximately twenty two (22) stores in Canada and in the United States listed in Schedule A enclosed herein (the “Participating Stores”), from April 1rst to April 30th, 2009 at Participating Stores’ closing time (the “Contest Period”).

ELIGIBILITY

2. The Contest is open to residents of Canada and the 50 states of the United States and the District of Columbia (except Puerto Rico, US Virgin Islands and Guam) who have reached the age of majority in their province, state or territory of residence as of their entry date. Employees, agents and representatives of the Contest Organizers, of any company, corporation, trust or other legal entity controlled by or affiliated to them, Participating Stores, their advertising and promotional agencies, suppliers of material and services related to this Contest, as well as members of their immediate family (brothers, sisters, children, father, mother), their legal or common-law spouse and any individuals with whom such employees, agents and representatives are domiciled, are not eligible.

This Contest is subject to all federal, state and local laws and regulations. VOID WHERE PROHIBITED.

HOW TO ENTER

3. To enter, proceed as follows:

3.1 During the Contest Period, visit a Participating Store and purchase any Lolë product, subject to availability. Upon completion of your transaction, the cashier will provide you with an Entry Form while supplies last;

3.2 Legibly fill out your Entry Form by entering your full name, complete address including postal code, phone number including area code and language;

3.3 For residents of Canada only where the following is required for Contest and prize awarding to be lawful, correctly answer the mathematical skill-testing question on the Entry Form;

3.4 Place your duly filled out Entry Form in the Contest box available at the cash desk at a Participating Store no later than April 30th, 2009 before closing time. Entry Forms facsimiles are not accepted.


4. NO PURCHASE NECESSARY. To enter without purchase, simply visit any Participating Store during the Contest Period and go to the cash desk where you will be provided with an Entry Form, upon request, while supplies last, which you must duly fill out and place in the Contest box in compliance with the provisions of sections 3.2 to 3.4 of these Contest Rules. For legal residents of Michigan and Ohio only: You may also enter by mailing your contact information which must include your full name, complete address including postal code, language and phone number including area code in an envelope with sufficient postage marked “Attention: 2009 “Win a Bike” Contest” to a Participating Store of your choice among those listed in Schedule A of these Contest Rules for it to be received no later than April 30th, 2009 before closing time.

5. Limits. Entrants must respect the following limit otherwise they may be disqualified:

• one (1) Entry Form per person, per week and per envelope with sufficient postage, as the case may be.

PRIZES

6. Approximately twenty two (22) prizes are offered, one per Participating Store. Each prize consists of a Marin cruiser bike for women, Stinson, Ez-Step model, 15”, of an approximate value of $540 USD ($590 CAN).

7. The following conditions apply to each prize:

7.1 The colour of the bike is yellow with Lolë cosmetic;

7.2 Since the bike may be on display in Participating Stores, it will be awarded in the condition as it is shown;

7.3 The prize may differ from the illustration appearing on the Contest advertising.

8. Limit. There is a limit of one (1) prize per person and per household.

DRAWS

9. Between 9:00 a.m. and noon on May 1st, 2009, each Participating Store will hold a random draw of one (1) eligible entry among all entries received at its Store during the Contest Period.

10. Odds of winning. The odds of an entrant’s entry being selected for a prize depend on the number of eligible entries received during the Contest Period at each Participating Store where the entrant entered the Contest in compliance with these Contest Rules.

AWARDING OF PRIZES

11. To be declared a winner, each selected entrant must:

11.1 Be reached by phone by the Participating Store’s representative within fifteen (15) days of the draw;

11.2 Have correctly answered the mathematical skill-testing question on the Entry Form (for residents of Canada only);

11.3 Within twenty (20) days of being reached by the Participating Store’s representative, claim the prize at the Participating Store where he/she was selected. However, if required by law and if an entrant’s residence is more than 30 km away from the Participating Store where he/she was selected, upon request, he/she may make appropriate arrangements with the Participating Store to take possession of his/her prize;

11.4 Immediately fill out and sign the Declaration and Release Form (the “Declaration Form”) that a representative of the Participating Store will provide him/her upon claiming of the prize. For entrants who have taken arrangements in compliance with the previous section, the Contest Organizers or a representative of the Participating Store will provide the Declaration Form by mail, fax or e-mail and the entrant will have to return it to the Contest Organizers within fifteen (15) days of its receipt.

12. Failure to comply with one of the conditions mentioned in these Contest Rules or to accept the prize will cause the selected entrant to be disqualified. In such a case, the Participating Store will hold a new draw until an entrant is selected and declared a winner. All prizes will be awarded.

GENERAL CONDITIONS

13. Verification. Entry Forms, requests by mail and Declaration Forms are subject to verification by the Contest Organizers. Any Entry Form, request by mail or Declaration Form which is, as the case may be, incomplete, illegible, mutilated, fraudulent, reproduced mechanically or any other way, submitted late, does not permit to correctly identify the entrant, not bearing the correct answer to the mathematical skill-testing question (for residents of Canada only) or otherwise noncompliant shall be rejected and will not entitle to an entry or to a prize, as the case may be.

14. Requests by mail. The Contest Organizers and Participating Stores are not responsible for requests by mail that were improperly sent, sent late or lost. The Contest Organizers suggest that the entrants send their requests by registered mail.

15. Disqualification. The Contest Organizers reserve the right to disqualify a person or to cancel one or several entries of a person who participates or tries to participate in this Contest by using methods that do not comply with these Contest Rules or that are unfair to other entrants (e.g. entry form obtained from an unauthorized source, entry exceeding the authorized limit, etc.). Such a person may be reported to the appropriate legal authorities.

16. Conduct of the Contest. Any attempt to deliberately sabotage the legitimate conduct of this Contest constitutes a violation of civil and criminal laws. Should there be any such attempts, the Contest Organizers reserve the right to reject the entrant’s entries and obtain legal or equitable relief under applicable laws.

17. Acceptance of prize. Prizes must be accepted as described in these Contest Rules and may not, in any case, be transferred to another person, replaced by another prize or exchanged for cash, except as provided in the section below.

18. Substitution of prize. In the event that it is impossible, difficult and/or more onerous for the Contest Organizers to award a prize as described in these Contest Rules, they reserve the right to award a prize of the same kind and of equivalent value or, at their sole discretion, the cash value of a prize as indicated in the Contest Rules.

19. Prize taxes. All taxes (including but not limited to federal, provincial and municipal taxes) related to a prize or arising from a prize, if any, and the consequences related to the reporting obligation attached to them are the sole and exclusive responsibility of the winners.

20. Liability limit: use of the prize. By entering the Contest, any entrant selected for a prize releases and holds harmless the Contest Organizers, any company, corporation, trust or other legal entity controlled by or affiliated to them, Participating Stores, their advertising and promotional agencies, their employees, agents and representatives from and against any damage resulting from the acceptance or use of the prize.

21. Prize assembly. Assembly of the bike is the sole responsibility of each Participating Store and the Contest Organizers disclaim all liability regarding that matter.

22. Prize warranty. Any entrant selected for a prize acknowledges the only warranty applicable to the prize is the standard manufacturer warranty.

23. Liability limit: conduct of the Contest. The Contest Organizers, any company, corporation, trust or other legal entity controlled by or affiliated to them, Participating Stores, their advertising and promotional agencies, their employees, agents and representatives disclaim all liability for any of the following that may limit or prevent any entrant from reading the Contest Rules: malfunctioning of any computer component, software or communications line; loss or lack of a communications network; or any transmission that is faulty, incomplete, incomprehensible or erased by any computer or network. The above-mentioned persons also disclaim all liability for any damages or loss that may be caused, directly or indirectly, in whole or in part, by the downloading of any web page or software or by the transmission of any information related to participation in the Contest.

24. Contest modification. The Contest Organizers reserve the right, at their sole discretion, to cancel, terminate, modify or suspend this Contest in whole or in part, should human intervention or an event take place that could alter or affect the administration, security, impartiality or conduct of the Contest as provided in these Contest Rules (subject to approval by the Régie des alcools, des courses et de jeux du Québec, if required).

25. Termination of participation in the Contest. In the event that participation in the Contest must be terminated in whole or in part, for whatever reason, before the closing date provided in these Contest Rules, each Participating Store may, subject to the Contest Organizers’ approval, proceed with the draw among the entries duly received at its Store up to the date of the event ending participation in the Contest at its Store.

26. Prize limit. In no event shall the Contest Organizers be required to award more prizes than indicated in these Contest Rules or to award a prize otherwise than in compliance with these Contest Rules.

27. Liability limit: participation in the Contest. Persons who enter or try to enter this Contest release the Contest Organizers, any company, corporation, trust or other legal entity controlled by or affiliated to them, Participating Stores, their advertising and promotional agencies, their employees, agents and representatives from any liability for damage these said persons may incur as a result of their entry or their attempt to enter the Contest.

28. Authorization. Except where prohibited by law, by entering this Contest, any entrant selected for a prize authorizes the Contest Organizers and their representatives to use, if required, his/her name, photo, likeness, voice, place of residence and/or statement regarding a prize for publicity purposes, without any form of compensation. A statement to such effect will be included in the Declaration Form.

29. Communication with entrants. No communication or correspondence related to this Contest shall be exchanged with entrants except as provided for in these Contest Rules or at the Contest Organizers’ initiative.

30. Personal information. Entrants’ personal information collected for the purposes of the Contest will only be used to administer the Contest. No commercial or other communications unrelated to the Contest will be sent to entrants unless they have otherwise agreed to receive such communications. 31. Property. Entry Forms, requests by mail and Declaration Forms are the property of the Contest Organizers and shall not in any case be returned to entrants.

32. Entrant identification. For the purposes of these Contest Rules, the entrant is the person whose name appears on the Entry Form or on the request by mail, as the case may be, and it is to this person to whom the prize will be awarded if he/she is selected and declared a winner.

33. Contest Organizers’ decision. Any decision by the Contest Organizers or their representatives regarding this Contest is final and without appeal (subject to a ruling by the Régie des alcools, des courses et des jeux du Québec on any issue under its jurisdiction).

34. Litigation (for Quebec (Canada) residents only). Any litigation respecting the conduct or organisation of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux du Québec for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie for the purpose of helping the parties reach a settlement.

35. Litigation. Each entrant agrees that any and all disputes that cannot be resolved between the parties, and all causes of action arising out of or in connection with this Contest shall be exclusively before a court located in Montreal, Quebec having competent jurisdiction, which court shall apply the laws of the Province of Quebec to adjudicate the dispute.

36. Sections divisibility. If a section of the Contest Rules is declared or deemed illegal, unenforceable or invalid by a competent court, that section shall be considered invalid, but all unaffected sections will be applied within the limits of the law.

37. Language. In case of any discrepancy between the French and English versions of these Contest Rules, the French version shall prevail.

38. Winners List. For a list of winners of a prize, send a self-addressed stamped envelope to be received by September 1st, 2009 to 619 Le Breton, Longueuil (QC) Canada, J4G 1R8.
